Terms and Conditions:

When registering on the website and entering a competition via the website an entrant is accepting that they have read these terms and conditions and agrees to be bound by them.

 

  1. Qualifying Persons

1.1 Greenlight Credit Limited t/a Bonanza Giveaways (‘The Promoter’) operate competitions – skill based games resulting in the allocation of prizes in accordance with these terms and conditions on the website www.bonanzagiveaways.com (the ‘website’) – (the ‘Competition(s)’).

1.2 The competitions are open to private individuals (e.g. not companies) aged 18 and over excluding The Promoter and their employees.

1.3 The Promoter reserves the right to close a customer’s account at any time, if they feel the customer is 1. abusing any services offered. 2. Being abusive to other customers or staff directly or on any social media platform. 3. They have belief that it is not genuinely the customer registered that is entering.

1.4 The Promoter reserves the right to refuse a customer’s entry at their own discretion.

 

  1. Legal Undertaking

2.1 By entering a Competition the entrant (‘you’) will be deemed to have legal capacity to do so, you will have read and understood these terms and conditions and you will be bound by them and by any other requirements set out in any related promotional material.

2.2 These Competitions are governed by English Law and any matters relating to the Competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction.

2.3 In the event that you participate in a Competition online via our Website, and by accepting these Terms and Conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our Competitions. The Promoter will not be held responsible for any entrant entering any of our Competitions unlawfully. If in any doubt you should check with the relevant authorities in your country.

 

3. Competition Entry

3.1 Competitions may be entered via the website. Multiple Competitions may be operated at the same time by the Promoter and each Competition will have a specific Prize.

3.2 Availability and pricing of Competitions is at the discretion of the Promoter and will be specified at the point of sale on the Website.

3.3 In order to enter a Competition, you will first need to register an account with us. You can register an account online via the website.  When registering an account online you will be asked to provide an email address and secure password.

3.4 In answering the Question, the Entrant recognizes that they must exercise Skill, Knowledge and Judgement to give the correct Answers; if answered incorrectly, The Entrant will not be included in the draw.

3.5 A maximum number of entries are stipulated within each Competition via the “number of tickets” drop down box. This is the maximum entries permitted per Entrant for the particular competition.

3.6 To conclude an entry into the Competition, an Entrant will be asked to provide their contact details (including postal and e-mail addresses and a telephone number) and card payment details (for entry fee only). Once the Entry is submitted, the Entrant’s card payment will be electronically approved via our merchant provider “Paytriot Payments”

3.7 When the Maximum Number of Entries and/or the Closing Date is reached, the Competition will close; however, the Promoter reserves the right to extend the closing date at its discretion.

3.8 All Entries to the Competition are final and no refunds shall be made at any time or for any reason, except in the case of entries submitted after the Closing Date or if the Promoter decides to cancel the competition due to lack of participation.

3.9 The Promoter’s decision is final and no correspondence will be entered into about the result of the Competition following the determination of the Winner.

3.10 Each Entrant agrees that the usual requirement under the Consumer Protection (Distance Selling) Regulations 2000 for any goods and services ordered online to be supplied within 30 days will not apply to this Prize Competition.

 

4. Postal Entry  

To be eligible to enter the Competition for free, you MUST have an active User account registered with us first. Thereafter send your: Full name, Address, DOB, Email address, contact phone number (including area code if providing a landline number). These details must match the details we hold on your User account to enable us to apply the entry. If we cannot identify an account from the details provided on the Postal Entry, then the entry will not be processed.

Postal Entries must be sent on a postcard by first class or registered post to the following address:

Bonanza Giveaways, Hersham Place Technology Park, Molesey Road, Walton-on-Thames, Surrey, KT12 4RZ.

Postal Entries are limited to one competition entrant per postcard (For example, in order to enter 5 times to a particular Competition, the entrant must send 5 separate Postal Entries) and must be handwritten in order to be valid and printed in legible English.

The Entrant must clearly specify which competition they wish to enter; and the correct answer to the entry question for the Competition they wish to enter. The Promoter will process all free entries on a Monday of each week. The free entries will be treated in the exact same manner as the paid entries, in addition the free entries will be entered into the ‘Live Draws’ in exactly the same manner. Standard Competition terms and conditions apply for free entries.  All entries must be received before the close of the competition, any entries that fail to follow the above criteria mentioned above will be void as per any Entry received.

The Promoter will not accept responsibility for Postal Entries that are lost, damaged or illegible.

In the event the Promoter decides to cancel the competition for lack of participation, we will not be responsible for entrants costs (e.g. postage and postcards) incurred for postal entries and therefore no refunds via this route will be made.

 

5. Closing the Competition

5.1 If the number of entries to the competition does not reach the maximum number of entries at the closing date, the Promoter reserves the right to extend the closing date of the competition until a sufficient number of tickets have been sold, or the remaining funds will be allocated as a cash prize to a winner after the deduction of any expenses and marketing fees.

5.2 The Promoter will be entitled to retain 30% of the Entry Fees to cover administration. The remaining balance following deduction of the 30% plus expenses (marketing, payment solutions, legal fees, website hosting) is “the Prize Fund”. The Prize Fund will then be offered to the winning Entrant;

5.3 If the Winner cannot be contacted by the Promoter within 7 days of being notified of their status as the Winner by e-mail, telephone, Facebook or mail via the contact details submitted along with their entry, then the Promoter reserves the right to then select an Alternate winner, who will then have 7 days to accept the prize following the same routes of contact as the original Winner. The original winner will have no claim to the prize after the Alternate Winner is selected.

5.4 The Promoter has the right to cancel a competition at any time and refund entrants.

5.5 If all the tickets haven’t sold in a competition after the competition has been extended the Promoter has the right to cancel the competition and refund the entrants.

5.6 The Promoter has the right to refund entrants if a competition does not sell the minimum number of tickets it needs for the Promoter to run the draw.

 

6. Contest / Selecting a Winner

6.1 The winning Entrant will be selected at random using a true random number generator Random.org https://www.random.org/ and promoted live via our social media platforms.

6.2 Full details of the draw date / time will be confirmed once the competition has been concluded via Facebook and or our website. This decision will be made within 48 hours of the close of the competition.

6.3 Entry lists will be displayed on our Facebook page – Bonanza Giveaways and/or our website at least 4 hours prior to any draw taking place, unless otherwise arranged or stated.

6.4 In some cases Draw Numbers displayed in “My Account” on the website may be subject to change until the draw is confirmed to be closed and entry lists are published.  For instance, if the competition closes early and less than the maximum number of tickets have sold.  Or in the rare case of any human or PC error.

6.5 There will only be one winner per competition unless otherwise stated.

6.6 If the contest is for a car and is completed and the Prize is issued successfully then the prize will be transferred by the Promoter to the winner of the contest using the V5 for each car. This must be completed before the car is handed over. The winner is responsible for taxing and insuring the vehicle as required and the Promoter will have no responsibility over the Prize(s) once hand over is completed.  The Promoter is not responsible for paying export or import taxes or costs if the winner lives outside the UK.

 

  1. Prize

7.1 The Promoter owns any prize offered from the time the competition is live until successful handover is completed as outlined in section 6.

7.2 The Promoter does not imply or give any warranty or accept any valuation to the Prize or guarantee the road worthiness in anyway shape or form. The Entrant must make up their own decision through their own enquiries and legal advice before entering the competition.

7.3 The prize will only be that as awarded at the time of the draw, no alternatives will be offered under any circumstance.

7.4 Collection of the prize is the sole responsibility of the winner, from the Promoter’s address unless otherwise agreed between the Promoter and the Winner.

7.5 The winner will be required to provide proof of identity and proof of entry into the competition at the time that the prize is collected.

 

  1. Personal details

8.1 All Winners will be required to provide photographs and videos or pose for photographs and videos, which may be used in future marketing and public relations by the Promoter in connection with the Competition and in identifying them as a winner of a Competition.

8.2 The Winner agrees to allow the Promoter to display his or her name on the Website in accordance with the Privacy Policy. The name and town of residence of the Winner will be posted on the Website for the purposes of announcing the Winner of the Competition within 24 hours of the Winner being determined.

8.3 Entrants authorise the Promoter to enter their personal details into their database and to use the information in accordance with the provisions of the Data Protection Act 1998 and subject to the terms of Privacy Policy.

 

9. Miscellaneous

9.1 The Promoter reserves the right to cancel the Competition at any time either before or after tickets have been sold. If the Competition is cancelled, the Promoter will return any Entry Fees paid to each Entrant (either by bank card refund or by cheque and in one combined payment where several entries have been made by a competitor or store credit). Where the Entry Fee is returned, the Promoter shall have no further liability to the Entrant or to any other person;

9.2 Save for death or personal injury the Promoter will not be liable for any loss (including economic loss) suffered to or sustained by any person or property as a result of any act or omission of the Promoters, nor will their servants or their agents in developing, planning and Administrating the Competition, distributing the Prize to the Winner or following the distribution of the Prize; The Promoter accepts no liability for errors or omissions contained within the Prize details, description or specification or any other part of the Website. It is the responsibility of each Entrant (and in particular the Winner) to satisfy him/herself as to the accuracy of any such details and/or any content of this website.

9.3 The Promoter will not be liable for any loss suffered by an Entrant as a result of incomplete entries or failed computer communications or for any loss suffered as a result of use of the Website.

9.4 The Promoter shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due. The Promoter shall use its best endeavours to ensure that the software and website(s) used to operate its Competitions perform correctly and accurately across the latest versions of popular internet, tablet and mobile browsers. For the avoidance of doubt, only the ticket coordinates recorded in our systems, howsoever displayed or calculated, shall be entered into the relevant Competition and the Promoter shall not be held liable for any competition entries that occur as a result of malfunctioning software or other event. Competition coordinates may be checked at any time by accessing your account at bonanzagiveaways.com.

9.5 No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorised human act, including any errors or mistakes. The Promoter shall use its best endeavours to award the prize for a Competition to the correct Entrant. If due to reasons of hardware, software or other computer related failure, or due to human error the prize is awarded incorrectly, the Promoter reserves the right to reclaim the Competition prize and award it to the correct Entrant, at its sole discretion and without admission of liability.

9.5 These competition rules shall not create or be construed as creating any form of contract, joint venture or other agreement between any Entrant and the Promoters.

9.7 An entry shall be declared void (without any refund being given) if the entrant engages in: (a) any form of fraud (actual or apparent); (b) fraudulent misrepresentation; (c) fraudulent concealment; (d) hacking or interference with the proper functioning of the website; or (e) amending, or unauthorised use of, any of the code that constitutes the Website.

 

10.Limits of liability

The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of the Promoter, the Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize Winner(s) and, where applicable, to any family/persons accompanying the Winner(s), or in connection with any of the Competitions promoted by the Promoter.

 

11. Data Protection Notice

11.1 Any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter to administer the Competition and fulfil prizes where applicable In order to process, record and use your personal data the Promoter may disclose it to (i) any credit card company whose name you give; (ii) any person to whom the Promoter proposes to transfer any of the Promoter’s rights and/or responsibilities under any agreement the Promoter may have with you; (iii) any person to whom the Promoter proposes to transfer its business or any part of it; (iv) comply with any legal or regulatory requirement of the Promoter in any country; and (v) prevent, detect or prosecute fraud and other crime. In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.

11.2 Acceptance of the prize by the Winner will mean they are required to have their photo and video taken by the Promoter for promotional purposes (Public Relations and Marketing), both immediately after their win and in the future for use in accordance with rule 6.2, unless prohibited by law.

11.3 By entering a Competition, you agree to the use of your name, address, and/or photograph or other likeness, as well as your appearance at publicity events without any additional compensation (save for reasonable travel expenses) and as required by the Promoter if you are declared a Winner.
